I have been informed that I have made some errors in this post. There are 51 sets of sexual assault laws in this country. They can be found on findlaw.com. These are the 50 states and Federal law. I did not check all of them and I did not include territories or possessions, however each body of laws regarding sexual crimes have various types, sentencing recommendations and those that cross state lines become federal. What I sensed in those I read was that various degrees of these crimes exist but I also think – only my opinion – that they should be codified better throughout the various legal systems. And I hold to the idea that the accused and the abused should both have due process. I should add that sexual crimes are very complicated and very much disagreed upon globally. But indeed they are, in this country, set down by each state and the federal government and guidelines, statutes and many laws exist. I apologize for not researching this better and I hope that simply by searching a state’s sex crimes law on the Internet these resources will answer questions I cannot. I am not in law enforcement nor am I an attorney. This post has been edited to reflect my errors.
What happens when you unleash predators and dump them into a big cage with room for many, many more? Some are misdemeanor predators with only one egregious act to their name and others are serial predators who would still be doing it if they had not been exposed. It’s a valid question because every crime on our books has degrees of offenses. Sexual crimes do as well (see above) – I would guess because it has been ignored, not believed, excused or just plain denied by the offenders or the legal and LE systems these laws may slip through the cracks. It has a statute of limitations in some states so if you got assaulted 26 years ago – time has run out and the offender walks.
For many reasons – that of shame, trauma and fear of not being believed,what are considered criminals among us who don’t get charged and we have #metoos who do not get their day in court. All these particular offenses are are not equal and herein lies the rub (sorry). Is a pinch on the butt equal to a rape in an alley? Is workplace harassment comparable to a gang rape in a fraternity house or at a party. Is substance abuse a factor? Is domestic abuse with rape the same as rubbing up in subway car? Can a husband rape a spouse legally. Is flirting frought with danger. Is it an invitation or is it so complicated a message it can be a crime to even do it? You know the variations on this theme and you also know that the acts themselves are not all the same. They may make us feel violated and threatened and dirty; but they are not all the same.
Those accused – whom we so readily name and those who are not named but pointed at – areoften not charged and therefore not proven guilty. The millions of #metoos are still only making accusations. And while these offenses include the murdering of the souls and psyches of the women and male victims who have been abused and violated, there are still very broad interpretations of such crimes by judges and juries. Frequently the evidence in any court would be one word against the other. I suspect even lawyers on both sides have issues with this problem.
How could you apply a statute of limitations on better defined degrees or would all sexual high crimes and misdeanors be treated exactly the same. Anthony Weiner provided proof of his own aberrations – and he made himself the villain because he was the villain. He is in the fedslam. He has been disgraced and he is being punished through the legal system. Due process.
Because a culture of fear and shame denied the violated, the violated were denied due process. I think if I were so inclined, I would sue those who perpetuated this. And if I were in the legal arena, I would collect all the evidence available and bring causes of action in each case that could be a cause of action. I would not favor the race or age or gender of the accused or their value to a college or a career or a future. Let Justice be blind. We are a nation of accomplished finger pointers. We use reputations to defame and extol many people who deserve neither. But I am more concerned with the way in which these crimes or alleged crimes (because people do lie) are handled and have been handled. And I speak personally; that not all people violated have their lives ruined. Many do, but many don’t. There are those of us who can relegate memories to a place where #metoo no longer has a daily impact or incessant pain. We are the fortunate ones.
While members of the Congress and commerce are resigning in droves and without due process we are committing further injustice and a rush to judgment outside the courts of law. This is wrong too.
I do not claim to have answers that are effective in the moment. But the crimes of a sexual nature; the rapes, the rubs, the feel-ups, the date rapes, the marital rapes, the campus rapes the injury, the accused who do go on trial, the anger, the retaliation all have to be placed in a context that other crimes against society and people are placed. This body of crime has existed for all of humanity. Some sought power, some sought satisfaction, some went nuts in war and kept on abusing. But in any context – this is not new. And as such we need to make it fit into our legal system better and be adjudicated as we do many other offenses.
And please remember that women and men can be #metoos.

Twelve years ago my husband was pistol whipped where he worked. The assailant hit him several time on the left side of his head leaving him with a closed head trauma, permanent disability, severe headaches and laundry lists of ongoing side effects that have gotten worse instead of better. For many years we thought this injury was caused by a closed fist until an eyewitness mentioned it had been a gun butt that was used. The men were armed. That is the full disclosure part.
When the framers wrote our constitution the second amendment was logical to me. A war had just been fought, trespass and killings still were a part of the landscape of 1776. Added to that many Americans shot for food. Disallowing guns to me seemed like a bad idea. I often think today we confuse the framers with the store front fortune tellers who can see all and tell all for a price. The men who wrote the constitution were not seers. They did not appear to have divine vision neither did they claim to have insider future info that guided them. I think they wrote a damn fine outline for a new and revolutionary country. An untried experiment. Until the American and French revolted royalty pretty much called the shots and it was an iffy business. In France (pre-1789), the birth of prince and then a princess was called the “choix du roi”. First you have an heir and then you marry off your daughter to another crown prince and gain more of everything. Marie Antoinette was an arch duchess of Austria. So one of the jobs of the framers was to abolish this entitlement of one ruling class and make everyone equal (sort of). What I’m not sure of is how long they expected this country to last or grow. Certain inalienable rights however were declared and bearing arms was one of them. You did not have to be a soldier of the king to strike fear into people who threatened your sovereignty.
Sadly the folks who like to shoot guns and desire to own and wear them are not always the good citizens. The bad guys too are equally entitled to have them. The 2nd amendment said nothing about shooting nor did it specify under what circumstances the arms could be used. Talk about your open to interpretation clause. The framers simply (I think) did not want Mr. John Q. American to be invaded by gun-toting foreigners who were going to steal their land and freedom. And I agree.
I am confused today about guns and gun laws and killers (well – not the killers). I do not own a gun for one reason only. I fear I would use it and I do not want that responsibility. Like the bell, once the bullet leaves the chamber it has its own path and once it’s on it, people can get hurt or killed. Like yesterday. So while I respect the second amendment for its desire to protect Americans from all enemies, foreign and domestic – I am not sure enough people really understand and truly respect the amendment and how profound it is. We live in confusing times. And as an aside – I think it is time for SCOTUS member Scalia to have at least the Minnesota Multiphasic

Ah Immigration. “Der goldene medina”, The Gold Mountain, The Promised Land (before aliyah). Didn’t folks used to get on the boat, get very seasick in steerage, disembark and try to blend in – eventually becoming citizens of the US. Wasn’t this a goal – a better life and citizenship. Certainly lots of people came in without documentation – but mostly it was about a good and generous county offering chance at a dream. The dream is over. We are a country suffering from every woe in the book; from BP’s oil greed in the Gulf to Mad Tea Parties and the threat of being blown up by religious fanatics. And Sarah Palin won’t go away. So we have a lot domestically, to address, in this country.
The issue of illegal immigration is a hot spot for Americans. And this is true on both sides of the issue. Some have soft spots in their minds for open arms and others would seal at least our southern borders with force fields if they could. For the 10%+ of this nation – the African Americans – this is a touchy issue and it should be. Stolen people, brought in chains built this country and served it for over 400 years. They were not immigrants. They were kidnapped and sold like animals to be slave labor. This country profited from their misery. This is hard cold fact. When the nation so generously “freed” them in 1865 – the free set up schools and businesses and towns and homes and – without even their 40 acres and mule – brought their own savvy, intelligence and culture to our country. Oops – too bad for them. How could we sit cheek by jowl with humans we had considered worse than animals? Equal rights? Not so fast. Next door? No. That’s wrong. Jim Crow – AHA! The light goes on and we create an abomination, solidly in place by 1910 called separate BUT equal – my ass. And even when this was abolished in 1964 – it never went away. So African Americans – who still bear the stigma and baseness of slavery and Jim Crow now have an additional obstacle to face – illegal immigration. They head my list – but the list goes on to the working poor citizen of every background who pays taxes and works hard and never gets to break even. If the government or Wall Street isn’t screwing us all, then we are paying bills for folks who come in illegally and ask for benefits. No visas period. It seems unfair.
Because many of us do find this unfair – we get to be labeled bigots. A word I use for the worst of our species. Some states try to seal their borders with laws and obstacles. The nation disapproves, but under its breath it whispers about “what a good idea”. Well for the unemployed citizens it is not a wrong reaction. I believe it is a myth that illegal immigrants take jobs no one else wants. I believe greedy and cheap employers hire illegals to make more money. I think they do not care about visas or green cards or anything else. If you were broke and out of work – would you be a gardener for $10 an hour? I bet you would but why pay that if you can get someone for $7.50 an hour – off the books. It’s pretty much that simple an equation. Would you like to flip burgers for minimum wage – just for some income – I bet you would – but you would probably hope to advance. People with iffy or no papers cannot rock their own boat. They are easier to fire and malleable; following invented rules to maintain the pecking order. They may know their rights – but are afraid to jeopardize their families by mentioning them. Companies like this. It keeps expenses low and profits high. So my own take on the myth of jobs no one else would do is just that – a myth.
Immigration rights groups in the Southwest and West tend to be largely Latino – probably because our country borders Central and South America. So this becomes a fascinating accelerant, used by both sides to fuel the fire. As the fire of bigotry rages – the problem and any solution die from smoke inhalation. For example:
One side says: “You hate us and don’t want us to come because we are brown and don’t know English”. The other side says we don’t hate you; “enter legally, speak English and you are welcome to be here. (not that simple but in a nutshell). Which is a no win argument. And it is fostered by both sides this way (and the point of this blog):
This was an ad I kept seeing on my AOL computer screen: “Latinos! Encuentran las mejores tasa enseguros de vehiculos! Cotizacion gratis?”.
1. It was in Spanish but advertised US car insurance. So it was directed at a US demographic.
2. It invited a specific group to its services “Latinos”.
3. This implied that only that group would benefit.
Why is this a problem? Substitute the word “Latinos” for
1White People”
2. “Jews”
3. Black People
You get the idea. It would create problems.
Yet when Spanish speaking illegal immigrants come here we have de facto bi-linguality that is puzzling. While we expect – as a country – our residents to be English speaking – we make an exception for speakers of Spanish. Doesn’t it imply: “Hey, come on in – we will even use your own language to make it easier.” How does this encourage any immigrant from south of our border to learn to navigate in the English speaking US? What is it saying about our own position on Spanish speaking illegal immigrants? No wonder people are confused. No wonder it becomes easy to polarize. No wonder we can all sound like bigots by simply agreeing with just one of only TWO premises.
I think we need to decide once and for all that illegal means just that. You are breaking a law and you may not come here, live and work by doing so. But we also need to remove the second language that accommodates our neighbors, encourages them and creates a unique group of residents called “Latinos” who won’t get with the program and join us speaking English – outside the home and church. Why is that so hard to imagine.
Why can’t we start with this conversation – leave the words “racist” and “bigot” out of it and discuss like civilized people how to start fixing this problem? Does anyone have an opinion or answer. Bring it on.

Part 1. A little background
It is hard not to hate Israel. Here is a little country that just won’t go away. And it’s got an army of willing soldiers – no burnt out prison drop outs recruits – the IDF loves Israel. They know how to do their jobs and more than that – they know why they are doing them. Sitting on a piece of spiritually important land that has been under siege since time immemorial – they cover their borders and do what they must to protect their country.
Israel’s larger problem – one of many – is that it is full of Jews. Nobody likes Jews – a case in point was the nastiness in WW2 that Hitler didn’t solve, to his regret. But Hitler’s idea had a huge family tree and Jew hating, Jew-berating and Jew-baiting has been an historical pastime since easily 93 CE. Well a game that can last that long isn’t gonna disappear quickly.
Israel became Israel a long time ago and before other newer religions co-opted the area – Jews held the stewardship of Israel and they held it seriously. The West Wall of the Temple – in size alone – is an indication of just what the Israelis were able to create a long time ago. Smitten, smited, smote – they soldiered on moving like a tribe of outcasts throughout their Diaspora. In Arab lands they became “dhimmies”. “Dhimmies can never be citizens but they do have to pay and they pay and pay and pay at the whim of whomever is in charge. The do NOT have equal rights. They serve a purpose because they know how to work and take care of their own. The image of a Jewish dhimmi laying around sucking on a hookah, out of work, may have happened – but I haven’t found any reference to it. SO the fact they contribute – despite Draconian code and laws – is just another reason to hate them. Fact is that Judaism follows so many holy observances that it’s hard to have time to work and pray and plot.
Israel is a productive country. What? Jews aren’t farmers or factory workers. It has scientific and manufacturing sectors, garment trades, agriculture and all the talents the Diaspora brought together in 1948 (and of course before). And Jews are a creative and talented people. In the 101 year history of Alfred Nobel’s Prize – 180 of the winners have been Jews – from various countries – but Jews. People hate that. For the record nine Muslims have won the Nobel Prize; five of which have been for Peace*. (*There is an interesting argument about this which is too long to discuss here.) Mostly they figure some huge Jewish conspiracy rigged it all and so the prizes aren’t all that important. But ask someone casually if they were to win the Nobel Prize for anything – how would they feel? The answer is usually the same. The time for the International Zionist New World Order speech never goes away but you all know what it is.
I won’t bore you.
Part 2 A little foreground.
And now it comes to Gaza. Gaza is a political and ideological and religious mess. There are so many sanctions related to it that I would never get them all in order and/or I would bore you to tears. Let’s just say that Israel relinquished the Gaza Strip by accord and let it go. When a terror group (Hamas) won the elections in Gaza – the surrounding countries seemed to have a problem with that, including Israel. Israel built a big wall. Not very neighborly but ghetto mentality creates ghetto ingenuity. Gazans went south to their brother in faith and purpose – Egypt – Egypt built a wall. Draw your own conclusions.
Into the picture comes the Guerilla Flotillas. “Humanitarian” ships that have been offered docking and offloading in two countries – Egypt and Israel. The offering countries also agreed to get the goods to Gaza right away. Cyprus refused to allow to dock. How rude. I can see not trusting Israel – but Egypt. What’s the problem? Israel told the ships not to approach an embargoed Gaza. The Guerilla Flotillas did it anyway. Israel went to stop them and all hell broke loose. People were shot, people were injured and people are mad. Now some idiot Irish ship is chugging to where it doesn’t belong to try the same thing. Turkey (who thinks someone recently died and put them in charge) has issued stern warnings to “dem Jews”.
Part 3 My own observation
In my opinion there is not a two state resolution – a simple look at the map of the area will show a first grader you cannot accept a country in pieces in another country you hate. Illogical, a waste of effort, time and money. Humanitarian aid is abundantly available from dozens on non-allied agencies – their books are clean and show no ties to Jihadis. (Oops – forgot Jihad – the engine that drives all this).
The received wisdom is that Gaza is a peace seeking, failed and barren state under siege with clean hands. This happened because Israel set it free and then Hamas took over. I would say it speaks more to the ability of Hamas to oversee a country than it does Israel letting it go. From the pix I have seen recently Gaza has a lot of food, people drinking coffee at cafes and plenty of potatoes. Smart Jews probably photo shopped them – but they look real to me.
So I can see why so many people hate Israel. And those crafty, clever, money making, smart productive Jews. What I cannot see is the rationale. Just as the QED in the Guerilla Flotillas. They sound more like a stupid, provocative act designed to force Israel’s hand and bring in things other than food and medicine. After the last 9 years – Why is this so hard for people to imagine. Or shall I dust off my burqua?

The forthcoming election (thank God) is bringing the perpetual immigration question back to the fore. Every “solution” is filled with landmines and this means nothing gets done because people are scared of stepping on toes. And there are lots of toes to be stepped on. The righteous right, the liberal left, the mediocre middle and the folks beating down a door to get into this country. So what really is the elementary problem? Well xenophobia is a huge factor – these folks are new and different and therefore we must fear them. One economics arguments comes in on a simplistic level – they take our jobs. Do they? (When was the last time anyone actually applied for a job cleaning toilet downtown at night?). They tax the system and steal our social benefits. Assimilationists argue they won’t fit in. Humanitarians argue they have to be absorbed. But I don’t think it’s all that complicated – it has simply been made so by our forked-tongued PC hypocrisy. First look at the who we are talking about when we say “immigrants” – oops, illegal immigrants. We are not speaking broadly of an international bunch of illegal immigrants – we are talking about Mexicans and Central Americans and we are talking about – largely – folks of indigenous heritage. So let’s take a risk and call it what it is right away. These folks are usually Catholic and they have lots of babies. They don’t come to the US to get PhD.s – they come to escape a life of dirt floors and not enough food in many central Latin American countries. They do this by sneaking over the border. Sneaking over the border is illegal and as such – no one is supposed to do it for any reason. Too bad for your dirt floors and snotty kids, but you can’t just amble or swim or coyote over the border when you want to come here. So on one level it’s a criminal act instantly and in doing it these folks are breaking the law and therefore are technically criminals before they even get a breath of air. So send them home. That’s one thing. But moreover, to us, how they get here is an act of risk and desperation and messy. Not at all the way we think people should come into the US. Most of us think planes and trains are more fitting. Catholic churches offer sanctuary – and why not – they have to at least look as though they practice what they preach. And these illegal border crossers fill empty pews in churches that are rapidly losing their congregations. And churches are sacrosanct, so we can’t raid the church and ship the folks in hiding, back over the border because that would violate something – I am not sure exactly what – but it does. The next level of disdain and argument is what they are. They are peasants. We don’t have peasants in America and we don’t like them. It’s a shame too because we might have a better work force if we did. These Latino peasants are often unread and uneducated and speak Spanish and don’t feel good about trying to learn English. So we get annoyed. But instead of making it simpler for them to use English- we print lots of stuff in Spanish and English. This is an unfair mixed message. You don’t see it in other countries very often. We haven’t made it essential to learn English and so many don’t. Why bother? Would you? This presents a weird dichotomy because their children often emerge from our schools bi-lingual – something we don’t often produce in native born kids. So they wind up better equipped for better jobs in the public sector because of this very bilinguality and we get pissed about that. Moreover, in peasant culture your wealth is your children. That doesn’t really change for them here. And better yet, babies born in the US are automatically US citizens – probably something that should have been better thought out when we made it a law. You have to do more in other countries to get the official seal and the work permit. Being born isn’t enough. Yet we oblige ourselves to offer these tiny citizens (and their families) the same benefits as other Americans and this includes the social welfare system. You can see where I am going with this. And because we are essentially a cheap nation when it comes to wages – these people present a perfect chance to get cheap help with cheap pay in cheap jobs that are not very appealing. Certain cultural characteristics make many Latinos very polite and agreeable and so when it’s time to get a raise they get fired instead and don’t make too much of a stink. Americans sue. Why wouldn’t you hire the cheap labor at the best price and the added value of fast turnover? There is a little Wal-Mart in all of us .
But even more, the nub of the whole mess is money. Many, many illegal immigrants become citizens one way or another but there are others who don’t. But either way – we allow them to export US money (in the form of wages in high value dollars) back home. One LATimes story put the exportation of USD at 6 billion in a six month period giving USD the distinction of being Mexico’s most profitable GNP.
Here is my suggestion. Why not just take the carrot off the stick and see what happens as a result. No more giros to Mexico.No envio dineros – No mas. Stop giving automatic citizenship to all immigrant newborns here and set a ceiling on how much anyone can send back home to improve another country’s economy. (Years back Britain would not allow UK subjects to bring more than a certain amount of pounds out of the UK. ) Others have come to this country with their diamonds the soles of their shoes – not to mention undies. Most illegals come with nothing. But we must stop putting the blame on the peasants who, after all, just want a better bite of the apple Remove the damned apple. Do as Canada does – insist potential workers bring something to the table. We can’t improve the politics south of the border so give up that pipe dream. Simply get rid of the incentive for trying to cross the border. Declare an amnesty on anyone who made it over and then end the ride there. No harm, no foul, no lamp. And enforce it. The last I looked no statue was lifting her lamp beside the golden door on either our northern or southern borders.
